The Kremenets District Court of Ternopil Region, by its decision, overturned the resolution imposing a fine of 17 thousand hryvnias on a man, who is a father of many children and a person with a disability, for committing an offense related to violating military registration.
This is stated in the decision of March 20, 2025.
The conscript himself filed a lawsuit with the court, deciding to appeal the decision to hold him administratively liable under Part 3 of Article 210-1 of the Code of Administrative Offenses and to impose a fine of 17 thousand hryvnias.
As it turned out in court, the man had updated his military conscript data in the "Reserve+" system on time, had a deferment from mobilization as a person with a disability, and also as a father of many children.
The man did not receive the summons to the CCC sent in November 2024 because he was abroad, and another summons sent in January 2025 was not served on him because the registered letter was returned to Ukrposhta with a corresponding note that the addressee was absent at the specified address.
On February 28, 2025, by a resolution of the CCC, a man was fined 17 thousand hryvnias for violating military registration, which he is appealing in court.
During the study of the written materials of the case, the court drew attention to the fact that the CCC resolution did not indicate on what grounds the man was summoned to the CCC and did not indicate which military registration data he did not update in a timely manner, but at the same time it was stated that the conscript violated military registration.
"Under the circumstances, his actions do not reveal any guilt, either in the form of intent or negligence; it is not specified which military registration data the plaintiff did not update in a timely manner," the court decision states.
Thus, the court did not find the elements of an administrative offense of violating military registration and overturned the decision to impose a fine on the conscript.
